Welcome to CertMonitor ("we", "our", "us"). These Terms and Conditions ("Terms") govern your use of the CertMonitor website and services ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
1. About the Service
CertMonitor is a certificate monitoring platform that helps users monitor SSL/TLS certificates and receive notifications before certificates expire or when issues are detected.
While we aim to provide accurate and timely monitoring, the Service is intended as an aid only and should not be relied upon as your sole method of managing certificates or infrastructure.
2. User Accounts
You are responsible for:
- Maintaining the security of your account credentials.
- Ensuring that the information you provide is accurate.
- All activity carried out under your account.
You must notify us immediately if you believe your account has been compromised.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to interfere with or disrupt the Service.
- Reverse engineer or attempt to gain unauthorised access to our systems.
- Use automated methods that exceed our published API limits.
- Monitor domains or services you are not authorised to monitor where doing so would breach applicable laws or agreements.
We reserve the right to suspend or terminate accounts that abuse the Service.
4. Fair Usage Policy
To ensure reliable service for all customers, CertMonitor operates a Fair Usage Policy.
Unless otherwise agreed in writing, we may apply reasonable limits including (but not limited to):
Notifications
We reserve the right to limit the number of notification emails, SMS messages, webhook deliveries, or other alerts generated by an account.
Where excessive notifications are generated due to configuration errors, unusually large numbers of monitored certificates, or abusive behaviour, we may:
- Temporarily delay notifications.
- Throttle notification delivery.
- Require an upgrade to a higher subscription tier.
- Suspend notification delivery until the issue is resolved.
API Usage
API access is subject to rate limiting.
Unless otherwise specified in your subscription:
- Requests may be rate limited on a per-account or per-IP basis.
- Excessive requests may receive rate-limit responses or temporary blocks.
- Attempts to bypass rate limits are prohibited.
API limits may be changed from time to time to protect the stability and performance of the Service.
Resource Usage
Where an individual account consumes resources significantly beyond what would reasonably be expected for its subscription tier, we reserve the right to:
- Apply additional limits.
- Request that usage be reduced.
- Require an upgrade.
- Suspend or terminate the account if excessive usage continues.
5. Availability
We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation.
Maintenance, upgrades, third-party failures, network issues, or events beyond our reasonable control may affect availability.
6. No Service Level Agreement (SLA)
Unless explicitly agreed in a separate written contract, CertMonitor is provided without any Service Level Agreement (SLA).
We do not guarantee:
- Any minimum uptime.
- Continuous availability.
- Response times.
- Notification delivery times.
- Monitoring frequency.
- Resolution of issues within any specified timeframe.
Service levels may vary due to maintenance, infrastructure issues, third-party providers, or other operational requirements.
7. Monitoring Accuracy
We make reasonable efforts to provide accurate monitoring information.
However:
- Certificate data may occasionally be delayed.
- Internet connectivity issues may prevent monitoring.
- Third-party services may fail.
- DNS or network issues may affect monitoring results.
You remain solely responsible for managing, renewing, and validating your certificates.
8. Limitation of Liability
To the fullest extent permitted by law, CertMonitor is provided on an "as is" and "as available" basis.
We shall not be liable for any loss or damage arising from your use of, or inability to use, the Service, including but not limited to:
- Expired certificates.
- Service interruptions.
- Missed or delayed notifications.
- Incorrect monitoring results.
- Business interruption.
- Loss of revenue.
- Loss of profits.
- Loss of contracts.
- Reputational damage.
- Loss of data.
- Indirect, incidental, consequential, or special damages.
You acknowledge that certificate management remains your responsibility and that you should maintain your own monitoring, renewal, backup, and operational procedures.
To the maximum extent permitted by law, our total liability for any claim relating to the Service shall not exceed the amount paid by you to CertMonitor during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
9. Third-Party Services
The Service may rely upon or integrate with third-party providers, including cloud hosting, DNS providers, email services, webhook destinations, and notification services.
We are not responsible for failures, delays, or outages caused by any third-party provider.
10. Fees and Payments
Paid subscriptions are billed in advance.
Unless otherwise stated:
- Subscription fees are non-refundable.
- Failure to pay may result in suspension or termination.
- Prices may change with reasonable notice.
- Applicable taxes may be added where required by law.
11. Suspension and Termination
We may suspend or terminate your account if:
- You breach these Terms.
- You misuse the Service.
- Your payment is overdue.
- Your use threatens the security or stability of the platform.
You may stop using the Service at any time. Termination does not affect any rights or obligations that have already arisen.
12. Intellectual Property
All intellectual property rights in the CertMonitor website, software, branding, and documentation remain our property or that of our licensors.
These Terms do not transfer ownership of any intellectual property.
13. Privacy
Our handling of personal data is described in our Privacy Policy. By using the Service, you acknowledge that we may process your data in accordance with that policy.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be published on our website and, where appropriate, notified to account holders.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
